Terms of use

1. Scope

These terms apply to the use of the website lagecheck.at ("Lagecheck"), operated by Bohdan Andrusyak, Graz. Use is free of charge and requires no registration.

2. What the service is

Lagecheck provides information on the location of addresses, prepared automatically according to published rules from official open data and from OpenStreetMap. The LAGE score and its parts are computed indicators. They are not a valuation of a property, not an expert opinion and not legal, tax, building, purchase or investment advice, and they do not replace a viewing or information from the competent authorities.

The underlying data reflects the state of its respective publication. It may be outdated, incomplete or wrong, and its preparation may contain simplifications and estimates, which are marked as such. The official documents always prevail. Zoning, building regulations, hazard zones, flood risk, heritage protection and building projects must be checked with the competent authority before any decision.

The information under "Projects nearby" is an experimental service. Some projects were captured automatically from tender and register texts and are marked as such; check this information with the linked source.

3. Warranty and liability

Lagecheck is provided free of charge. No warranty is given for the accuracy, completeness or timeliness of the content. Liability for damage arising from the use of the content or from reliance on it is excluded unless it is caused by intent or gross negligence. Liability for personal injury and mandatory statutory liability remain unaffected.

4. Availability

There is no entitlement to constant availability of the website or of individual functions. Content, functions and these terms may be changed or discontinued at any time.

5. Links to other websites

Lagecheck links to sources and services of third parties. Their operators alone are responsible for their content. No unlawful content was apparent when the links were set; links will be removed if infringements become known.

6. Copyright and data licences

The texts, design and program code of Lagecheck are protected by copyright. The data used comes from the bodies listed under Sources and licences and is subject to their licences, mostly the Creative Commons Attribution 4.0 licence (CC BY 4.0) and, for data from OpenStreetMap, the Open Database License (ODbL). Lagecheck has processed this data (calculations, distances, averages). Anyone reusing data from Lagecheck must comply with the terms of these licences.

7. Automated access

Mass automated retrieval of content, in particular of building reports, is only permitted within the limits set in the robots.txt file. Requests that impair operation may be limited or blocked. An interface for machine use is available on request.

8. Applicable law and jurisdiction

Austrian law applies, excluding the conflict-of-law rules of private international law. For consumers, the mandatory provisions of the law of their habitual residence remain unaffected, as do the places of jurisdiction under § 14 of the Austrian Consumer Protection Act (Konsumentenschutzgesetz).

9. Language

These terms are available in German and English. The German version is binding.
